1.2       Mechanistry is highly committed to the protection of privacy of Mechanistry’s Website Users and the security of their personal data processing.

1.3       This Website privacy policy is for information only and does not impose any obligations on the Users.

2.          DEFINITIONS

2.1       Controller – a personal data controller, i.e. Mechanistry;

2.2       Controller’s Partners – Mechanistry’s trusted partners that help provide Electronic Services to the Users;

2.3       Cookies  – files recorded on the User’s Account which store settings and other information used on websites visited by the User;

2.4       Electronic Services – services provided electronically by Mechanistry, i.e. Newsletter, User Account, Internet Forum;

2.5       Mechanistry – the owner of the Internet domain mechanistry.com, i.e. Mechanistry spółka z ograniczoną odpowiedzialnością with its registered office in Rondo Daszynskiego 2B, 00-843 Warszawa, Poland, entered in the Commercial Register of the Polish Court Register under KRS number: 0000630339, NIP: 5272775893, REGON: 36502672600000;.

2.6       GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR);

2.8       Newsletter – an Electronic Service provided by Mechanistry via electronic mail consisting of distribution of commercial information to Users;

2.9       Privacy Policy – this document;

2.10    Internet Forum – a place of exchanging information and experience the subject matter of which is connected with the operations of Mechanistry, by Users, with potential participation of individuals engaged on the Mechanistry’s part;

2.11    User or you – a person using the Website;

2.12    User Account – an Electronic Service provided by Mechanistry via the Website enabling Users access to information on, modifying or terminating use of the Electronic Services;

2.13    Website – the website with sub-pages in the domain mechanistry.com;

3.          PERSONAL DATA PROTECTION

3.1       Personal data processing.

Personal data is processed in accordance with the Act of 10 May 2018 on personal data protection (Dz.U.2018.1000), and GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L 119, p. 1), as well as other legal acts supplementing or replacing the above mentioned regulations.

3.2       Personal data controller.

Mechanistry with its registered office in Rondo Daszynskiego 2B, 00-843 Warszawa, Poland, is the personal data controller.

3.3       Purpose of personal data processing

Personal data will be processed for the purpose of performing the Electronic Services contract and sending the Newsletter, as well as for the direct marketing of the Controller’s and third party products and services (in the latter case, provided that consent has been given for the processing of personal data for the purpose of third party marketing).

3.4       Basis for personal data processing.

Each time the purpose and scope of data processed by the Controller depend on your activities on the Website and are based on the provisions of law.

A legal basis for personal data processing is:

(a)                for the purpose of concluding and performing an agreement for the provision of Electronic Services – Article 6(1)(b) of the GDPR;

(b)               having to comply with Mechanistry’s legal obligations, i.e. for the purpose of handling complaints within the complaint procedure established as a requirement of the Act of 18 July 2002 on provision of electronic services (consolidated text in Dz.U.2019.123) and the Act of 30 May 2014 on consumer rights (consolidated text in Dz.U.2019.134) – Article 6(1)(c) of the GDPR;

(c)                processing necessary for purposes resulting from Mechanistry’s legitimate interests (collecting information about the Website use, saving settings and personalizing the User interface ensuring security, development and optimal operation of the Website, improvement of the quality of services, protection of rights and enforcement of claims, direct marketing of Controller’s products or services) – Article 6(1)(f) of the GDPR;

3.5       Type of data collection and its processing.

In connection with providing the Electronic Services, the following personal data of the User are processed:

(a)                user name;

(b)               e-mail address to which messages will be sent;

(c)                The Controller receives personal data directly from the User, and through Cookies  such as User’s internet protocol address (IP) and Internet behaviour data.

3.6       Transfer of data outside the European Union.

Personal data will be transferred to third countries  – recipients listed in pt. 3.7, below – on the basis of adequacy decision on the EU-US Privacy Shield.

3.7       Recipients of the personal data.

Personal data may be made available to the Controller’s Partners for the purposes of providing Electronic Services to Users. The Controller ensures that only necessary information is provided to the Controller’s Partners in order to attain the objectives for which the co-operation was entered into. Controller’s Partners may have potential or actual access to restricted User data and may process them on the Controller’s behalf. Personal data covered by this Privacy Policy are made available to the following Controller’s Partners that may process them on the Controller’s behalf only for the purposes specified below:

(a)                Google Ireland Ltd, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland – providing the Controller with tools for data analytics, and for sharing them;

(b)               Amazon Web Services EMEA SARL, 38 Avenue John F. Kennedy, L-1855, Luxembourg –  providing the Controller with tools for storage and internal management of data, and for sharing them;

(c)               Webflow, Inc., 398 11th Street, 2nd Floor San Francisco, CA 94103, United States of America – providing the Controller with website hosting tools;

(d)               The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA – providing the Controller with assistance in managing the Controller’s Newsletter and electronic communications by way of providing appropriate tools.

3.8       Use of data for automatic decision making or profiling.

Data will not be subject to automatic decision making or profiling.

3.9       Data storage period.

Data will be stored as long as the Electronic Service is provided and thereafter for another six years from the last event that may give rise to possible claims. For some claims, this period may be extended if a longer prescription period is provided for by law. The storage period for data processed for accounting purposes and for tax reasons will be in accordance with the applicable laws. After such periods the data will be erased or anonymized.

3.10    Requirement to provide data.

Providing personal data is voluntary, but necessary for performing the Electronic Services.

3.11    User’s rights

The Controller will ensure:

(a)                the right of access to data (Article 15 of the GDPR);

(b)               the right to request a rectification of data (Article 16 of the GDPR);

(c)                the right to request deletion of data (Article 17 of the GDPR);

(d)               the right to demand restriction of processing (Article 18 of the GDPR);

(e)               the right to data transfer i.e. to receive data which has been transferred to the controller in a structured, commonly used and machine-readable format, as well as the right to transfer such personal data to another controller (Article 20 of the GDPR);

(f)                 the right to object to data processing (Article 21 and Article 6(1)(f) of the GDPR).

4.          COOKIES  POLICY (AS PART OF THE PRIVACY POLICY)

4.1       Cookies

4.1.1          In order to make the Website more attractive and to make it possible to use certain functions, Mechanistry uses Cookies , which serve to protect Mechanistry’s legitimate interest of the optimal presentation of its offer.

4.1.2          Cookies  are small text files that are automatically saved on the User’s terminal equipment when they are using the Electronic Services. Cookies  usually contain the domain name of the website from which they originate, the time they are stored on the terminal equipment and a unique number.

4.2       Service Cookies

4.2.1          The Controller uses service Cookies  mainly to provide the User with Electronic Services and to improve their quality.  Therefore, the Controller and other entities providing analytical and statistical services to the Controller use Cookies  for storing information or gaining access to information already stored in the User’s telecommunications terminal equipment (e.g. computer, telephone, tablet).  Cookies  used for this purpose include:

(a)               user input Cookies;

(b)               authentication Cookies;

(c)                user centric security Cookies;

(d)               multimedia player session Cookies;

(e)               user interface customization Cookies;

(f)                Cookies  used to monitor traffic on the Website, i.e. for data analytics, including Cookies:

(i)                 used by entity contracted by the Controller to process personal data – for Website audience measurement, including the Internet Forum, and for analyzing the way in which Website and Internet Forum are used by Users, including the creation of statistics and reports on the Website and Internet Forum operations;

(ii)                Google Analytics files, i.e. files used by Google contracted by Mechanistry as the personal data controller to process it in order to analyze the way in which the Website and Internet Forum are used by the User, including the creation of statistics and reports on the Website operations;

4.2.2          Two basic types of Cookies are used on the Website: session Cookies and persistent Cookies. Session Cookies are temporary files that are stored in the User’s terminal equipment until the User logs out, leaves the Website or the software (web browser) is turned off. Persistent Cookies  are stored in the User’s terminal equipment for the time specified in the parameters of Cookies  or until deleted by the User.

4.2.3          The Website uses the following types of Cookies :

(a)               “strictly necessary” Cookies   enabling the use of services available on the Website, e.g. authentication cookie used for services requiring authentication on the Website;

(b)               “performance” Cookies  that collect information on how visitors use Website;

(c)                functional Cookies  allow “remembering” the User’s customization and interface personalization.

5.1       The Website may contain links to other websites.  Mechanistry recommends that when you go to other websites, you should read their privacy policy. This Privacy Policy applies only to the Mechanistry’s Website.

5.2       Mechanistry applies technical and organizational measures ensuring the protection of the processed personal data adequate to the risks and categories of protected data, and in particular protects data against disclosure to unauthorized persons, collection of data by an unauthorized person, processing in violation of applicable regulations, as well as change, loss, damage or destruction.
